I. General Terms and Conditions
General
All services provided by amia de lis for the customer are subject exclusively to the following General Terms and Conditions (GTC)
.
They shall be deemed to have been accepted when an order is placed or a delivery is accepted. Any terms and conditions of the customer that conflict with or deviate from these GTC shall not apply. Deviating provisions shall only apply if they have been agreed in writing between amia de lis and the customer.
No liability is accepted for data transmission errors or typographical errors.

Offer and conclusion of contract
The presentation of the products does not constitute a legally binding offer, but a non-binding invitation to order.
An order can be placed via our website. By ordering the goods (pressing the purchase button), you place a binding order for the goods contained in the shopping cart. The purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail.
An order can also be placed by e-mail, e.g. for individual customer requests. By doing so, you submit a legally binding offer that you wish to conclude a contract with us. The purchase contract is concluded when we accept your contract offer by sending you an order confirmation by e-mail.
Prices
The prices quoted are final prices and include 19% VAT. Shipping/delivery costs are not included in the final prices quoted.
Payment
All goods must be paid for in advance. The goods will be dispatched after receipt of payment and completion of the goods. The delivery time is displayed for each item in the online store.
Shipping
Shipping is carried out exclusively by Post/DHL; the costs for postage (up to 25 kg) and packaging are € 4.90 within Germany.

EU abroad 1 7,50€ registered letter, uninsured (liability for lost goods is not accepted!)

Switzerland 1 6,30€ (net) International goods post, uninsured (liability for lost goods is not accepted).

Note DHL Paket: Please make sure that someone is present on the day of delivery or that a neighbor can accept your order. DHL will make a maximum of four delivery attempts, after which the goods will be returned to the sender. Unfortunately, we have to charge shipping costs again for a new delivery.
Right of return
As all items are only made to order and made to measure, they are excluded from the right of return. However, should there be any reason for complaint, the return shipment must be agreed with the owner amia de lis in advance. In the event of a withdrawal, the payments made, excluding shipping costs, will be refunded after the goods have been returned.
Warranty

Choice of law, place of performance, place of jurisdiction
(1) German law shall apply. In the case of consumers, this choice of law shall only apply insofar as the protection afforded by mandatory provisions of the law of the state of the consumer’s habitual residence is not thereby withdrawn (principle of favorability).
(2 ) The place of performance for all services arising from the business relationships existing with us and the place of jurisdiction shall be our registered office if you are not a consumer but a merchant, a legal entity under public law or a special fund under public law. The same applies if you do not have a general place of jurisdiction in Germany or the EU or if your place of residence or habitual abode is unknown at the time the action is brought. The right to appeal to the court at another legal place of jurisdiction remains unaffected by this.
(3) The provisions of the UN Convention on Contracts for the International Sale of Goods shall expressly not apply.
Please notify us immediately and in writing of any obvious defects in the goods, as well as transport damage, within 14 days of delivery of the goods at the latest. After this period, warranty claims due to an obvious defect are excluded. An insignificant deviation of the goods from the illustrations on the Internet, in color and design, does not constitute a defect. Our products are custom-made, so that deviations in color and design are possible, which are not covered by the warranty. Amia de lis is only liable for damage to the goods themselves. Further claims by the customer are excluded. Liability for consequential damages is excluded. When choosing a leash, please take into account your dog’s ability to walk on a leash, its weight and temperament and select the leash thickness accordingly.
Retention of title
The goods remain the property of Amia de lis until payment has been made in full.

Copyright and right of use
The pages of our website and the images and texts contained therein are protected by copyright. The use and reproduction is not permitted without the express permission of the owner of amia de lis. Our company reserves all rights.

5 Prices and terms of payment
5.1. The prices listed in the respective offers as well as the shipping costs represent total prices. They include all price components including all applicable taxes.
5.2. The shipping costs incurred are not included in the purchase price. They can be called up via a correspondingly labeled button on our website or in the respective offer, are shown separately during the ordering process and are to be borne by you additionally.
5.3. Any costs incurred for the transfer of money (transfer or exchange rate fees charged by credit institutions) shall be borne by you in cases where the delivery is made to an EU member state but the payment was initiated outside the European Union.
5.4. The payment methods available to you are shown under a correspondingly labeled button on our website or in the respective offer.
5.5. Unless otherwise stated in the individual payment methods, the payment claims arising from the concluded contract are due for payment immediately.

6.2. If you are a consumer, it is regulated by law that the risk of accidental loss and accidental deterioration of the sold item during shipment only passes to you when the goods are handed over, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company not named by the entrepreneur or another person designated to carry out the shipment.
